Term & Condition – Chef

TERMS AND CONDITIONS

Cookhike may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are binding on you.

By using the app, (creating a profile) Chefs are accepting the below specified Terms of Use:

1. Chefs are responsible for informing Cookhike if they are unable to take orders due to prior commitments, sickness, holidays, etc. The Chef’s inability to inform Cookhike in a timely fashion can result in penalties as deemed fit by Cookhike. The Chef is required to update their Leave Dates on the app through their personal dashboard.

2. Chefs are responsible for making comprehensive profiles on Cookhike, providing detailed menus, quantities, pricing and all other specifics like preferred mode of delivery, desired notice period for orders and / or any other special services provided. Cookhike will not be responsible for any discrepancies that may arise thereafter.

3. In case of any copyright infringement due to photographs uploaded by chefs on their profile, liability will lie on chefs and not on Cookhike. The chef must use real photographs of his/ her dishes only.

4. Once a Customer places an order on Cookhike, the Chef must confirm the order, whereby he commits to the details of said placed order. Cookhike will not be liable for any discrepancies that may arise thereafter.

5. The Chefs are solely responsible for preparation and timely delivery of food (as per terms specified on their profile) as well as for maintaining quality and hygiene. Cookhike will not be responsible or liable for the quantity or quality of meals delivered.

6. The Chef by being on the platform acknowledges and agrees that a substantial portion of the compensation the app receives for making the Site available to the chef is collected as a commission on the money you receive for orders to the clients. Therefore, once you identify or are identified by any party through the site, you must inform cookhike.com of such an order and pay the commission for work arising directly or indirectly with that party or arising out of your relationship with that party.

8. Cookhike will not be responsible for any health damages or sickness caused due to the food delivered by the Chefs.

9. The Chef will follow the basic hygiene and safety requirements as laid down by the FSSAI. If they fail to do so, the Chef may be asked for a refund of the full order value to the client.

11. Cookhike will monitor Chefs closely, using Customer feedback provided in any form to Cookhike and will remove and block Chefs if they are unable to comply with our standards and / or tarnish our reputation.

12. Any information provided by the Chef including photos, menu items, profile descriptions, etc. can be used by Cookhike for various purposes, including business development, promotions, etc.

13. Cookhike is not responsible for any liability, if any, that may arise from the misuse of the shared information, if any, or from the consumption of any food and beverages prepared by a Chef.

14. The Chefs cannot, under any circumstances, place orders on their own profiles.

15. Neither parties, be it the Customer, Cookhike or the Chef shall be responsible to the others for any delay or non-performance of its obligations under this agreement arising from any cause beyond its control including, without limitation, any of the following: act of God, governmental act, war, fire, flood, explosion or civil commotion.

16. Chefs are legally obliged to add Cookhike branding to all orders that have been forwarded to them by Cookhike.

17. For corporate orders, the payments will be made as per the corporate’s payment cycle.

18. All Chefs must complete the KYC formalities with Cookhike, no payments will be made to chefs who have not completed their KYC formalities.

19. Chefs are entitled to request a copy of the personal information we hold on you. Please contact us if you wish to request this information.

20. All information submitted by the chef, whether in the contract, KYC or for the purpose of FSSAI is verified and true. Chefs will be liable for any lien, loss, penalties that may arise due to any discrepancies found.

21. Disclosure

We may disclose to third party services certain personally identifiable information listed below:

• Information you provide us such as name, email, mobile phone number

• Information we collect as you access and use our service, including device information, location and network carrier

This information is shared with third party service providers so that we can:

• Personalize the app for you

• Perform behavioral analytics

Code of Conduct

1. It is mandatory that the chef register with the FSSAI as a Food Business Operator (FBO). The chef can view the process on the following link- How to Apply.

2. The chef is required to maintain proper hygiene to make and package the food. The chef must have a clean and sanitized working environment in order to insure the food is safe to consume, without the food causing any health problems.

3. The ingredients used in the food should be of good quality. Ingredients that are expired, stale, rancid, rot, spoiled, amongst others should be avoided for use in the food prepared by the chefs.

4. Employment of children in any form by chefs is strictly prohibited. Chefs should only employ those who are at least 18 years of age. All applicable laws relating to child labour including employment, wages, working hours, overtime and working conditions shall be complied with.

5. The chef must be punctual while preparing the food and handing it over to the logistics partner for a timely delivery. The food must be prepared in a timely fashion and be packaged by the time of pickup so that there is no delay in the food reaching the customer. The chefs are given enough time for the food preparation to ensure that the food is delivered to the customers in a timely fashion.

6. The chef is liable to inform Cookhike regarding any leaves so that the chef’s profile can be deactivated and customers can’t place orders in the chef’s absence. To ensure a smooth functioning of the marketplace and ease of use for the customer, the chef’s menu must be updated with prices, dishes and availability.

By using the app, (creating a profile or placing an order) Chefs and Customers are accepting the below specified Terms of Use.

1. Any contract that arises out of orders for supply of food through Cookhike is a contract between Customers and Chefs.

2. Chefs are responsible for making comprehensive profiles on Cookhike, providing detailed menus, quantities, pricing and all other specifics like preferred mode of delivery, desired notice period for orders and / or any other special services provided. Cookhike will not be responsible for any discrepancies that may arise thereafter.

3. 9. Cookhike will not be responsible for any loss incurred by Customers due to any actions of the Chefs including the non-performance and untimely delivery of the orders.

10. The Chef will follow the basic hygiene and safety requirements as laid down by the FSSAI. If they fail to do so, the Chef may be asked for a refund of the full order value to the client.

11. Cookhike will send regular reminders to Chefs for the said commission and will be liable to cancel their registrations upon nonpayment to Cookhike.

12. Cookhike will monitor Chefs closely, using Customer feedback provided in any form to Cookhike and will remove and block Chefs if they are unable to comply with our standards and / or tarnish our reputation.

13. Any information provided by the Chef including photos, menu items, profile descriptions, etc. can be used by Cookhike for various purposes, including business development, promotions, etc.

14. Cookhike is not responsible for any liability, if any, that may arise from the misuse of their shared information, if any, or from the consumption of any food and beverages prepared by a Chef.

15. We disclaim any and all liability to the Customer for the supply of the Food Delivery, Goods and Services to the fullest extent permissible under applicable law. This does not affect the Customer’s statutory rights as a consumer.

16. When ordering from Cookhike, Customers may be required to provide an e-mail address and password. Customers must ensure that they keep the combination of these details secure and do not provide this information to a third party.

17. When ordering from Cookhike, Customers will receive an automated confirmation email specifying the details of the placed order. Customers are required to check this email carefully and must inform both Cookhike and the Chef immediately in case of any discrepancy.  The said automated confirmation email is not the same as the actual confirmation from the Chef committing to fulfill the order.

18. All discounts, promo codes, cash backs, loyalty discounts and other such benefits are applicable on online orders (placed on app or mobile app) only.

19. Any discounts or promotions including referral promotions offered by Cookhike.com are in good faith. Any user trying to misuse the offers can be banned or the offer can be revoked at any point, the rights to do so solely rests with Cookhike.com.

20. The Chefs cannot, under any circumstances, place orders on their own profiles.

21. Cookhike reserves the right to remove or revoke credit (referral or otherwise) from customer’s accounts on identification of misuse, expiration of offer etc.

22. Cookhike reserves the right to limit usage of credit, whether by way of amount, which chefs / dishes it may be applied on, or in any other way it see’s fit.

23. We have taken all reasonable steps to prevent Internet fraud and ensure any data collected from you is stored as securely and safely as possible. However, we cannot be held liable in the extremely unlikely event of a breach in our secure computer servers or those of third parties.

24. You are entitled to request a copy of the personal information we hold on you. Please contact us if you wish to request this information.

25. Cookhike strives to ensure that all information on this app is correct and error free. We apologize for any errors or omissions that may have occurred. We cannot warrant that the use of Cookhike will be error free or fit for purpose, timely, that all errors will be corrected; or that the site or server that makes it available are free of viruses or bugs. We do not make any warranty whatsoever, whether express or implied, relating to the fitness for purpose, accuracy or reliability.

26. Disclosure

We may disclose to third party services certain personally identifiable information listed below:

• Information we collect as you access and use our service, including device information, location and network carrier

This information is shared with third party service providers so that we can:

• Personalize the app for you

• Perform behavioral analytics

27. Cookhike can remove any credit in any customers account at it’s own discretion.

28. By accepting our Terms & Conditions, you are giving Cookhike permission to send promotional communication about, but not limited to, offers, new chefs, dishes or cuisines etc.
